CONSTITUTION

 

-PREAMBLE-

 

Be it known that the Joint Chapter of the Gamma Xi Chapter of Kappa Kappa Psi, Honorary Fraternity for College and University Bandmembers, and the Beta Eta Chapter of Tau Beta Sigma, Honorary Sorority for College and University Bandmembers, is an organization operating exclusively within the University of Maryland Bands on the College Park Campus for the following several purposes.

 

1.  To promote the existence and welfare of the University of Maryland Bands and to cultivate and maintain a wholesome respect for their activities and achievements.

 

2.  To honor outstanding bandmembers through the privilege of membership, extended as a reward for technical achievement and appreciation for the best in music.

 

3.  To stimulate campus leadership and promulgate an uncompromising respect, through the medium of the college band, for gracious conduct, good taste, and unswerving loyalty.

 

4.  To foster a close relationship between college bands and promote a high average of attainment through the performance of good music and worthwhile projects.

 

5.  To provide a pleasant and meaningful social experience for all engaged in college band work and to cooperate with other musical organizations in any manner consistent with the institution at which the chapters are located.

 

 

 

 

The Joint Chapters of Kappa Kappa Psi and Tau Beta Sigma shall be subject to the jurisdiction of each Chapter’s Sponsor or a specifically designated representative.

1.  General

 

1.01   This document establishes and prescribes the authorized regulations pertaining to the functions and     

the organization of the component parts of the body for which it is a part.

 

2.  Name

 

2.01   The name of the organization shall be the Joint Chapter of the Gamma Xi Chapter of Kappa Kappa    

Psi, Honorary Band Fraternity for College and University Bandmembers, and the Beta Eta Chapter of Tau Beta Sigma, Honorary Band Sorority for College and University Bandmembers.

 

2.02  Throughout this document the name Joint Chapter will refer to the official name as noted in section 2.01.

 

2.03  Throughout this document the names Chapter and Chapters will refer to the groups that compose the official organization and name as noted in section 2.01.

 

2.04  Throughout this document the name Brother will refer to a member of Kappa Kappa Psi, and the name Sister will refer to a member of Tau Beta Sigma.

 

3.  Rules of Order

 

3.01  The current edition of Robert’s Rules of Order, unless otherwise specifically stated in this Constitution, shall govern the deliberations of all component parts of the Chapter assembled in the meeting.

 

4.  Constitution Adoption

 

4.01  This Constitution shall be considered adopted when the Joint Secretary/Treasurer of the Joint Chapter records the favorable votes of three-fourths (3/4) of the eligible voting membership of the Joint Chapter.  This Constitution shall be considered effective immediately upon adoption.

 

4.02  Any and all previous Constitutions, together with any and all amendments and by-laws thereto, shall become void and are superseded by this Constitution upon approval.

 

5.  Constitutional Amendments

 

5.01  The Joint Jurisdiction Committee may submit a proposed amendment for the Constitution to the Joint Chapter for consideration.  Proposed amendments shall be presented at regularly called meetings of the Joint Chapter.  All proposed amendments must be presented to the Joint Chapter by the Jurisdiction Committee.

 

5.02  A minimum deliberation period of two (2) weeks shall pass between the time that the proposed amendment is presented to the Joint Chapter by the Joint Jurisdiction Committee and the Joint Chapter’s voting on the proposed amendment.

 

5.03  The proposed amendment shall be voted on at a regularly called meeting of the Joint Chapter.  If at least three-fourths (3/4) of the active membership present voted favorably on the proposed amendment, it shall be declared adopted.  The present membership shall equal or be greater than the specified amount for a quorum.

 

5.04  Adopted amendments to the Constitution shall be written and added as integral parts within the Constitution.  The Joint Chapter membership shall have access to a written copy of the newly adopted amendments, from the Joint Jurisdiction Committee, by the next regularly scheduled Chapter meeting.

 

5.05    Amendments that have been adopted by the Joint Chapter shall be considered effective

immediately after review as prescribed in paragraph 4.01 of this Constitution. 

5.06  No amendment may contradict any rule or policy established by each Chapter’s individual constitution.

 

6.  By-Laws

 

6.01  Definition: A by-law is a rule by which an organization is governed.  Therefore, a by-law is an addendum to the Constitution that will be in effect unless repealed, amended, or superseded, for the duration of the academic year.  At least two-thirds (2/3) of eligible members present must vote favorably on the proposed by-law for it to be adopted.

 

6.02  A by-law may not contradict any part of the current Constitution.

 

6.03  A two-thirds (2/3) majority vote of eligible members present will be necessary to repeal, amend, or supersede an existing by-law.

 

7.  Officers

 

7.01  Joint Chapter officers listed in descending order shall be: Joint Chairs, Parliamentarians, Joint Secretary/Treasurer,.

 

7.02  The selection of Joint Chairs shall be done prior to the first regularly called meeting following the induction of the last membership class of the academic year, or at the next-to-last regularly called meeting before the end of the academic year.  The Joint Secretary/Treasurer shall alternate between chapters each academic year. The Chapter Presidents shall serve as Parliamentarians.

 

7.03  Selection of Joint Chairs and the Joint Secretary/Treasurer shall be governed by each Chapter’s Constitution.

 

7.04  Each Joint Chapter Officer shall be an active member of the Fraternity or Sorority in good standing at the time of appointment and during the Officer's entire term of office.  Each Joint Officer shall be willing and able to devote sufficient time and energy to the execution of the responsibilities and the duties of the office during their entire term.

 

7.05  All Joint Officers must have served at least one academic semester as an active member of his or her respective organization before being considered for a Joint Office.

 

7.06  Each Joint Chapter Officer shall serve for a period of one (1) year, or until the succeeding Joint Officer has been appointed.

 

7.07  In the event that a Joint Officer does not attend to the duties of the office in a satisfactory manner, as seen fit by the active membership, the respective Chapter may remove that Officer in a manner consistent with that Chapter’s Constitution.

 

7.08  Each Chapter’s Constitution shall govern the appointment of an interim Joint Officer between the time of the resignation or removal of a Joint Officer and the appointment of a new Joint Officer.

 

7.09  The Joint Chairs shall preside at all meetings of the Joint Chapter and be members ex-officio of all Joint committees.  All contracts and other instruments of business incurred by the Joint Chapter shall be signed by one of the Joint Chairs. The Chapter Presidents and Joint Chairs shall assist the Joint Secretary/Treasurer in developing a budget for the upcoming fiscal year. The Joint Chairs shall also act as the SGA Liaisons for the Joint Chapter.

 

7.10  The appropriate Chapter President, in the absence of the Joint Chair at a Joint Chapter meeting, or if the office of Joint Chair is vacated, shall perform the duties of the office of Joint Chair. In the absence of the appropriate Chapter President, the duties of Joint Chair shall be performed by the next highest ranking Chapter Officer in accordance with that Chapter’s Constitution. 

 

7.11  The Joint Secretary/Treasurer shall record the minutes of all meetings of the Joint Chapter.  The Joint Secretary/Treasurer shall keep a running list of all by-laws passed by the Joint chapter, separate from the minutes, with a copy of the list given to the Parliamentarians.  The Joint Secretary/Treasurer shall control the receipts and disbursements of all monies of the Joint Chapter and shall submit recommendations concerning the financial policies of the Joint Chapter as may be required. The Joint Secretary/Treasurer shall deposit all monies received, by the next regularly scheduled meeting.  The Joint Secretary/Treasurer, in conjunction with the Joint Chairs and Chapter Presidents, will be responsible for developing a budget for the upcoming fiscal year.

 

7.12  The Joint Parliamentarians shall be responsible for advising the chair on matters of Parliamentary Procedure, and constitutionality of motions.

 

7.13  The Joint Chapter Officers shall serve without compensation.

 

8.  Committees

 

8.01  The standing committees of the Joint Chapter are the Joint Committee and Joint Jurisdiction Committee.

 

8.02  Special, or ad-hoc, Committees may be created by the Joint Chapter, Joint Chairs, and/or the Chapter Presidents.

 

8.03  The Joint Chairs shall appoint all committee members, except for the Joint Committee, whose members shall be appointed by each Chapter President.  All committees shall consist of at least two (2) active Brothers and two (2) active Sisters, including the chairperson, but not including any members ex-officio.

 

8.04  Members of all ad-hoc committees shall serve until relieved of their appointments by the Joint Chairs, or until the end of the academic year.

 

8.05  Members of all standing committees shall serve until relieved of their appointments by the appropriate Chapter President, or until the end of the academic year.

 

8.05  Committee descriptions:

 

8.05.01  The Joint Committee shall be responsible for all actions and/or activity pertaining to the Joint Chapter.  These activities include, but are not limited to, receptions for musical events, banquets, and fund-raising ideas.  The Joint Committee must also prepare an agenda for each Joint Meeting prior to the calling of the meeting. The Joint Committee shall consist of the Joint Chairs, the Joint Secretary/Treasurer, the Chapter Presidents, the Chapter Treasurers, and the members of each Chapter’s Joint Committee.

 

8.05.02  The Joint Jurisdiction Committee shall be responsible for all actions concerning the Constitution and matters pertaining thereto.  These activities include, but are not limited to, proposing Constitutional amendments, making changes to the Constitution after changes have been passed by an appropriate vote, and enforcing the Constitution.  The Joint Jurisdiction Committee shall be comprised of, at least, the Chapter Presidents and Chapter Trustee/Parliamentarians.

 

9.  Delegates and Proxies

 

9.01  Representation of the Joint Chapter, when necessary, shall come from the membership of the Joint Chapter and selection will be left to the discretion of the Joint Chairs.

 

 

 

 

10.  Meetings

 

10.01  A regularly called meeting of the Joint Chapter shall be held bi-weekly during the regular academic school year of the University, or at the discretion of the Joint Committee.  The dates of the regularly called meeting shall be determined at the beginning of each semester by the Joint Committee, and a schedule shall be drawn up and distributed to all Brothers, Sisters and prospective members of each organization.

 

10.02  Members must be given at least ten (10) days notice of a regular meeting to be held responsible for attendance at the meeting.

 

10.03  Special Joint Chapter meetings may be called by the Joint Chairs, Chapter Sponsors, or one-third (1/3) of the active membership of the Joint Chapter.  Special meetings may be held as often as deemed advisable by the Joint Chapter.   The exact time of the meeting will be determined by the party calling the meeting.

 

10.04  Fifty percent plus one (50% + 1) of all active Brothers, and fifty percent plus one (50% + 1) of all active Sisters, shall constitute a quorum at all Joint Chapter meetings.

 

10.05  Assigned committee meetings shall be called by the appropriate committee chairperson.  The date and time for each meeting shall be posted with at least one 10 days notice given before the meeting is to be held.

 

10.06  Attendance of assigned committee meetings is mandatory. Penalty for missing a meeting is determined by the policies in each Chapters’ Constitution.  If a member is assigned to more than one committee and attendance at one committee meeting conflicts with another committee meeting, the member shall be excused from all but one committee meeting, provided the member informs the chairperson on the committee(s) that there is a conflict.

   

10.07  Every active member shall be eligible to vote and participate in discussion at Joint Chapter meetings, except for the presiding Joint Officers, who may only vote to make or break a tie.

 

10.08  A motion shall be considered passed when the required majority of the motion, as defined by the Constitution and/or by Robert’s Rules of Order, is reached by the Brothers, and the Sisters, in separate votes.

 

11.  Finances

 

11.01  All monies of the Joint Chapter shall be received and expended by the Joint Secretary/Treasurer.  All expenditures shall be made by check, drawn on a bank designated by the Joint Chapter, and signed by either of the Joint Chairs, the Joint Secretary/Treasurer, or either of the Chapter Presidents, or from petty cash, upon the presentation of receipts for the materials to the Joint Chapter.

 

11.02  Any expenditures over the amount of fifty dollars ($50) must be approved by a majority of the Joint Chapter. Any expenditures equal to or under fifty dollars ($50) must be approved by either of the Joint Chairs or the Joint Secretary/Treasurer.

 

11.02  The fiscal year for the Joint Chapter shall be from June 1st through May 31st.

 

11.03  The financial policies of the Joint Chapter shall be governed by a budget adopted at the beginning of each fiscal year.

 

 

 

 

 

 

 

12.  Membership

 

12.01  Joint Chapter membership status is defined according each Chapter’s individual constitution.

 

12.02  Active members of the Joint Chapter shall be all active members in good standing of the Gamma Xi Chapter of Kappa Kappa Psi or Beta Eta Chapter of Tau Beta Sigma at the University of Maryland, College Park.

 

12.03  Unless decided by the by-laws, all Associate, Honorary, Alumni, Conditional, and Life members shall have rights to discussion.

 

12.04  Policies of required attendance are left to the discretion of each Chapter and its Constitution.
